1. Read this first

This matters when deciding where to send a notice. We cannot remove a stream, disable a channel, or take down a portal, because none of them are ours and none pass through our infrastructure. A notice sent to us about infringing video will not reach whoever is actually distributing it.

If you have identified an infringing stream, the effective recipients are the hosting provider serving that stream and its network operator. We will help you identify what we can, but we cannot act on the content itself.

2. What we can act on

We can and will act where the complaint concerns something we actually control:

• Our own material published on qsmart-player.net.
• Misuse of our brand — sites copying STB+ or QSmart names, our logo, screenshots or page design. Report these; we pursue them.
• Accounts of repeat infringers, where a specific licensed device is shown to be used for repeated infringement. We will deactivate the licence.

3. Sending a copyright notice

Send notices to legal@qsmart-player.net, or by post to QSMART LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, United States.

To comply with 17 U.S.C. § 512(c)(3), your notice must include all of the following:

• A physical or electronic signature of the copyright owner, or a person authorised to act for them.
• Identification of the copyrighted work claimed to be infringed.
• Identification of the material claimed to be infringing, with enough detail for us to locate it — a URL where possible.
• Your contact details: name, address, telephone number and email address.
• A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate, and — under penalty of perjury — that you are authorised to act on the owner's behalf.

Incomplete notices cannot be processed. We acknowledge valid notices within 5 working days.

4. Counter-notice

If material of yours was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address containing:

• Your signature, name, address and telephone number.
• Identification of the removed material and where it appeared before removal.
• A statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification.
• Consent to the jurisdiction of the Federal District Court for your district, or — if you are outside the United States — for any district in which we may be found, and acceptance of service of process from the complaining party.

Where a valid counter-notice is received, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action.

5. Repeat infringers

We terminate the licences of users who are shown to be repeat infringers, in appropriate circumstances and at our discretion, in line with § 512(i). A terminated licence is not refunded.

6. Brand and impersonation

We are particularly concerned with sites that sell content, channels or subscriptions using our name, since these damage both our customers and our standing with app stores and payment processors. Report them to legal@qsmart-player.net with the URL and we will act.
